TRESAL Comprehensive Privacy Notice

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (published in the Official Gazette of the Federation on March 20, 2025) and its Regulations, Transportes Especializados del Altiplano, S. de R. L. de C. V. (hereinafter “TRESAL”) makes available to its customers, employees, suppliers, job candidates, and the general public this Comprehensive Privacy Notice.

2. Personal data we collect

Depending on your relationship with TRESAL, we may collect the following personal data:

Identification and contact data (customers, suppliers, general public): full name, business or corporate name, address, email, phone number, RFC (tax ID), and, where applicable, the name of the company or organization you represent.

Data collected through our website (www.tresal.com): name, email, phone number, company, and message, provided voluntarily through our email.

Employee and job candidate data: full name, address, CURP, RFC, social security number (IMSS), INE voter ID or passport, proof of address, professional and personal references, and academic information.

Sensitive personal data: in the case of employees and job candidates, TRESAL may collect data considered sensitive under the Law, such as present and future health status (medical certificates, fitness exams for driving hazardous materials vehicles) and union membership. This data is collected exclusively to comply with labor and regulatory legal obligations of the federal motor carrier sector.

For the processing of sensitive personal data, TRESAL will obtain the data subject’s express written consent through a handwritten signature on the corresponding contract or form, or through an electronic signature or other equivalent authentication mechanism, prior to processing.

TRESAL will process sensitive personal data under strict administrative, technical, and physical security measures, limiting access solely to authorized personnel who need to know such information to perform their duties. This data will be used exclusively for the purposes described in this Privacy Notice and in accordance with applicable law.

Financial or asset data: in the case of suppliers and customers, TRESAL may collect banking data (CLABE account, bank) exclusively for payment or invoicing purposes.

3. Purposes of processing

Necessary purposes (which originate and are necessary for the legal relationship): provision of specialized transport services; preparation and follow-up of quotes; invoicing and collection; compliance with tax, labor, and regulatory obligations before the SICT, SAT, IMSS, and INFONAVIT; compliance with regulations applicable to the transport of hazardous materials; personnel administration and labor files; management of the ISO 9001:2015 quality system; identity verification, facility access control, monitoring of logistics operations, compliance with industrial safety requirements, and risk management associated with specialized transport and hazardous materials transport.

Voluntary purposes (which are not necessary for the legal relationship): evaluation of the quality of our services; sending information about additional TRESAL services; and invitations to industry events.

If you do not wish your personal data to be processed for the voluntary purposes, you may indicate so at the email guadalupe.soto@tresal.com. Refusal to use your data for these purposes will not be grounds for us to deny you the services you request or contract.

4. Transfers of personal data

TRESAL may transfer your personal data, without requiring your consent in the cases provided for by applicable law, to competent tax, labor, administrative, or judicial authorities, including but not limited to the Tax Administration Service (SAT), the Mexican Social Security Institute (IMSS), the National Workers’ Housing Fund Institute (INFONAVIT), the Ministry of Infrastructure, Communications and Transport (SICT), as well as any other authority that legally requires it.

Likewise, TRESAL may transfer personal data to insurance companies, customers, specialized service providers, external auditors, legal advisors, and other third parties related to the operation of specialized transport services, when such transfer is necessary to fulfill contractual, regulatory, legal, or operational security obligations.

Transfers of personal data will be carried out observing the security and confidentiality measures provided for by applicable law.

For transfers that do not fall within the exceptions provided for by the Law and that require your consent, TRESAL will expressly request such authorization. If you do not wish your data to be transferred to the operational third parties indicated in the second paragraph of this section, you may indicate so by contacting our Personal Data Department at guadalupe.soto@tresal.com.

5. Mechanisms to limit the use or disclosure of your data

You may limit the use of your personal data by contacting TRESAL directly at the email guadalupe.soto@tresal.com or at the phone +52 55 2620-0228 to request the limitation of the use or disclosure of your personal data.

You may also request at any time the exclusion of your personal data from our distribution lists for promotional or marketing purposes.

6. ARCO rights and revocation of consent

You have the right to Access your personal data, Rectify it if it is inaccurate, incomplete, or out of date, request its Cancellation, or Oppose its processing (ARCO rights). You may also revoke the consent you have given us for the processing of your personal data. These rights are recognized by the Federal Law on the Protection of Personal Data Held by Private Parties.

To exercise any of these rights, you must send a request to TRESAL’s Personal Data Department containing at least: (1) the data subject’s full name and address or email to communicate the response; (2) documents proving your identity (copy of INE, passport, or other valid official document); (3) a clear and precise description of the personal data with respect to which you seek to exercise any of the rights mentioned; and (4) any other element that facilitates the location of your personal data.

TRESAL will respond to your request within a maximum of 20 business days from the date of receipt. If applicable, it will be implemented within the following 15 business days.

TRESAL informs that it currently does not make decisions based solely on automated processing of personal data that produce legal effects or significantly affect the interests of data subjects.

7. Security measures for the protection of personal data

TRESAL implements reasonable and appropriate administrative, technical, and physical security measures to protect personal data against damage, loss, alteration, destruction, or unauthorized access, use, or processing.

All personnel involved in the processing of personal data are subject to confidentiality obligations.

In the event of a security breach at any stage of the processing of your personal data that significantly affects your property or moral rights, TRESAL undertakes to inform you immediately so that you can take the necessary measures to defend your rights.

8. Retention of personal data

Personal data will be retained only for the time necessary to fulfill the purposes described in this Privacy Notice and to meet applicable legal, tax, labor, regulatory, or contractual obligations.

Once such purposes have been fulfilled and the corresponding legal periods have elapsed, personal data will be deleted, blocked, or anonymized in accordance with applicable regulations.

9. Use of cookies and tracking technologies

Our website (www.tresal.com) uses cookies, web beacons, and similar technologies to improve the browsing experience.

These technologies may be used to remember browsing preferences, analyze usage trends, measure website traffic, and generate statistics that allow us to improve our services.
